The Drinking and Driving Law was overhauled in December 2018 by Parliament, by making the laws more strict and affording the police with additional powers when investigating these charges. The new law — An Act to amend the Criminal Code (offences relating to conveyances) and to make consequential amendments to other Act — amended the Criminal Code of Canada when it comes to DUI law and other driving offences.
The new wording of the DUI offences is set out unders. 320.14 of the Criminal Code. The section now reads: (1) Everyone commits an offence who

- (a) operates a conveyance while the person’s ability to operate it is impaired to any degree by alcohol or a drug or by a combination of alcohol and a drug;
- (b) subject to subsection (5), has, within two hours after ceasing to operate a conveyance, a blood alcohol concentration that is equal to or exceeds 80 mg of alcohol in 100 mL of blood;
Impaired Driving / DUI Charges in Toronto consist of a range of different types of offences. One of these is “Refuse or Fail to Provide a Breath Sample”.
Failure or refusal to comply with demand
Section 320.15 of the Criminal Code of Canada sets out the offence of Refusal/Failure to Comply with a Breath Demand.
The section reads “[e]veryone commits an offence who, knowing that a demand has been made, fails or refuses to comply, without reasonable excuse, with a demand made under section 320.27 or 320.28.”
Impaired Driving Causing Bodily Harm is a one of the more serious charges one can face in the DUI realm.
The criminal offence of Impaired Driving Causing Bodily Harm has the same elements as Impaired driving, with the addition of an aggravating feature of bodily harm being involved to one or more individuals. Typically, the harm is caused to: (a) passengers in a vehicle; (b) passengers in another vehicle or (c) bystanders.
Impaired Driving Causing Bodily Harm is a one of the more serious charges one can face in the DUI realm.
